4.19 Maintenance Guidelines

Property ownership includes the responsibility for maintenance of all structures and grounds which are a part of the property.  This includes, but is not limited to, items such as mowing grass, removal of trash and structural maintenance.  Maintenance affects the visual character and economic values of the property and neighborhood, and in some cases, safety.

4.19.1        Exterior Appearance

Residents are responsible for maintaining the exterior of their dwellings and any other structures on their lots, such as porches, decks, fences, sheds and playground type of equipment.

While it is difficult to provide precise criteria for what the Association deems as an unacceptable condition, the following cases represent some of the conditions which would be considered a violation of the Association Covenants:

a.  Peeling paint on exterior trim.

b.  Playground type equipment which is either broken or in need of repainting.

c.  Fences with either broken or missing parts.

d.  Sheds with broken doors or in need of repair.

e.  Decks with missing or broken railings or parts.  Porch decking shall be maintained according to provisions of section 3.4.1.c for decks.

4.19.2        Lawn and Yard Maintenance

Turf areas need to be mowed and maintained at regular intervals, maintaining a maximum height of 6 inches and minimum height of 2 inches.  Bald spots and dead areas in the turf shall be reseeded.  Changes to this requirement may be made according to specified plans submitted as part of an application to the ARB.  Planted beds must be kept in a neat and orderly manner.

4.19.3        Lawn and Garden Fertilization

All soil should be tested before any fertilizer is added, especially in areas where drainage will flow into ponds.  Special care should be taken when applying any fertilizer or pesticides.  In areas adjacent to ponds and waterways, fertilize in a manner to avoid runoff.  Soil test kits are available free from the County libraries or County Extension Office.

4.19.4        Debris and Clippings

Each resident is responsible for keeping their property free of litter or debris.  The common grounds of the Association are not considered dumping areas for any type of debris.  Grass clippings or leaves shall not be dumped in the common areas.

4.19.5        Erosion Control

Each resident is responsible for seeing that their lot area is protected from erosion and that storm drain structures are not blocked so as to cause additional erosion problems which will silt up ponds and stream valleys.

Most residents would not allow any of the above conditions to exist, as they seek to preserve and protect their investment in their homes and to limit their personal liability by keeping all improvements on their lots in good condition.  The Association expects that all residents will do this necessary maintenance to prevent any of the above cited conditions from occurring in Southern Oaks.
