3.1 Fences

3.1 Fences

Fencing can be used to separate property, provide security, visual privacy, or to architecturally define space.  In achieving any one of these goals, a barrier is created which has both a visual and a physical impact on the boundaries of common land and properties of adjacent homeowners.  Careful consideration should be given to the basic fencing concept and the manner in which the concept is executed.

3.1.1  Design Criteria

a.  Location.  Fencing shall be restricted to rear yard locations except in the case of end townhouse units where homeowners will be permitted to continue the fence to a point parallel with the rear of the porch.  Fencing shall be erected to all property boundaries.

Fencing involves boundary line consideration.  Therefore, applications must show exact relationship with property lines.

NOTE:  Due to the proximity of the townhouse units, homeowners may find that the existing privacy fences installed by the builder are located on their neighbor's property.  In such instances if a homeowner wishes to extend the existing privacy fence, a written authorization from their neighbor(s) specifically approving the fence extension must be included with the application.

The planting of flowers, shrubs, hedges or any other landscaping on, or overhanging, unfenced side and/or rear property lines is considered to take the place of a fence and requires ARB approval (see Section 4.18.1).

b.  Style.  Fences and gates shall be solid board-on-board style fences to match the existing privacy fences erected by the builder.  Posts must be capped.

c.  Height.  The height of all front and side fences shall be 6' 0".  The height of all back fences shall be either 3' 0" or 6' 0" - see above sketch.

d.  Materials and Colors.  All fences shall be made of natural wood, either cedar or pressure treated lumber, and left to weather.  Alternatively, fences may be stained with ARB approval.  Fences shall not be painted, and no metal fences are allowed.

3.1.2  Application Contents

All applications shall include the following information:

a.  Site plan showing the location and height of the fence and gate.

b.  Estimated start and completion dates.  (See Section 2.2.6)

c.  Signatures of adjacent neighbor(s), if appropriate.
